      <p>En el enfrentamiento coherente a la actividad delictiva es vital la existencia de una sólida política criminal, que encause el camino a seguir para contrarrestar con cierta efectividad el complejo y dinámico mundo del delito; desde las más sencillas transgresiones del ordenamiento legal hasta la consumación de los delitos más graves, así como la atención de los sancionados en los establecimientos penitenciarios. </p>
      <p>Si bien desde la teoría general de la ciencia criminológica se acoge el término de política criminal para definir el conjunto de medidas para el enfrentamiento de la actividad delictiva, en Cuba se le denomina política penal y penitenciaria. El libro “Política Penal y penitenciaria. El reglamento del sistema penitenciario en el contexto actual de desarrollo de la sociedad cubana. (Glosario jurídico - penitenciario)”, tiene el mérito de profundizar en unas de las aristas no menos compleja del enfrentamiento a la actividad delictiva, el tratamiento a los sancionados en los macos del sistema penitenciario. </p>
      <p>El autor discurre desde consideraciones generales sobre política criminal, hasta adentrarse y profundizar, con argumentos científicos y jurídicos, en la política criminal en Cuba, con un marcado énfasis en la dimensión que alcanza esa política general en el sistema penitenciario, que en definitiva es el objetivo central que se persigue y se alcanza con la edición del libro.</p>
      <p>Desde el capítulo V “Política penitenciaria y sus antecedentes”, el autor con unas breves ideas sobre el pensamiento martiano acerca de las prisiones, divide sus análisis, como casi siempre ocurre en este tipo de valoraciones, en dos grandes periodos, antes del triunfo de la revolución cubana el primero de enero de 1959 y a partir de este hecho histórico que cambio los destinos del pueblo cubano hacia un futuro más promisorio. (<xref ref-type="bibr" rid="B1">Zequeira, 2020</xref>).</p>
      <p>El libro solamente hace breves esbozos acerca del régimen penitenciario en Cuba antes de 1959, para dedicar espacio y tiempo a analizar el periodo más fecundo del despliegue de la política penitencia en Cuba, que inicio el primero de enero de 1959 y se extiende hasta nuestros días, aunque por razones lógicas el libro no aborda los más reciente logro de esta política como la aprobación de la Ley número 152 de 2022 “Ley de Ejecución Penal” (<xref ref-type="bibr" rid="B2">Repúbica de Cuba, 2022</xref>), y el rescate del pensamiento del Fidel acerca de la atención integral del sistema penitenciario, que incluye la extensión de la enseñanza universitaria al mismo.</p>
      <p>El profesional del derecho, el estudiante o cualquier persona que por razones diversas se adentren en el estudio de este interesante  libro, encontrara en el orden didáctico, que el capítulo VI se dividen en cinco breves momentos los principales hitos que ha tenido el tratamiento de la política penitenciaria en la Cuba revolucionaria, aunque en nuestra opinión es importante considerar, en el “Segundo momento”, los aportes del pensamiento del Comandante en Jefe Fidel Castro Ruz al desarrollo del sistema penitenciario, para lo cual sería útil acercarse el discurso pronunciado por Fidel, el día 6 de junio de 1971, en el acto por el décimo aniversario de la constitución del Ministerio del Interior.  </p>
      <p>Con el reconocimiento de la política penitenciaria como parte de la política criminal del Estado, en el capítulo VII se esbozan brevemente los tres enfoques que el autor define como bases de la dirección de una prisión; para dar paso en el siguiente capítulo a un somero análisis de la relación entre la política y el Derecho Penitenciario, aseverando que la política penitenciaria alcanza rango constitucional por primera vez con la aprobación de la Constitución de 2019, considerando lo establecido de forma explícita en el artículo 60 de la Carta Magna cubana.</p>
      <p>El lector debe evaluar que según lo establecido en el artículo 60 de la Constitución de la República de Cuba, la política penitenciaria rebasa el marco de los establecimientos penitenciarios, al incluir dentro de ella la reinserción social de las personas privadas de libertad, por ello en su instrumentación participar varios ministerios y las organizaciones políticas, sociales y de masas. </p>
      <p>Para el lector resultara interesante los “Puntos de vista sobre una prisión”, que se plantean en el capítulo IX del texto. Conceptos como “Ciudad mínima y completa”, “Prisión hospital”, “Prisión reloj”, “Prisión laboratorio” y “Prisión Instituto de Meteorología”; cautivarán la motivación de los que se acerquen a la lectura de libro; con los cuales desde una mirada crítica se podrá estar o no de acuerdo, pero sin lugar a dudas es un aporte del autor al debate sobre las complejidades que encierra el sistema penitenciario. </p>
      <p>Para los que se interesen en la política penitenciaria les será valioso conocer la definición de tratamiento penitenciario, por eso la utilidad de que su capítulo X el autor ponga en manos de los lectores algunos conceptos que sobre este término se han debatidos desde la ciencia, y las definiciones establecidas reglamentariamente. </p>
      <p>Cuando se analice la política penal y penitenciaria, no puede faltar la evaluación de los principios que sustentan el sistema penitenciario cubano, aspecto que se aborda con acierto en el capítulo XI de este interesante libro. Desde el “Humanismo” hasta el “Enfoque individual, diferenciado y sistémico del proceso educativo”, se explican los principales principios que sostienen el sistema penitenciario cubano. En el estudio de estos principios es adecuado revisar el anexo de la Ley de Ejecución Penal, donde se establecen conceptos y definiciones aplicables a ese cuerpo legal, y que define términos como humanismo, legalidad, derecho a la defensa, entre otros. </p>
      <p>Los capítulos XII y XIII esgrimen los principales aspectos de la organización y funcionamiento de los establecimientos penitenciarios. Aunque el objetivo de estos capítulos es ir de forma directa al funcionamiento interior de los establecimientos penitenciarios, no se puede obviar la existencia de una Jefatura del Sistema Penitenciario a nivel de la Jefatura del Ministerio del Interior en cada provincia, que dirige el funcionamiento integral de cada establecimiento penitenciario, ante la existencia de más de uno en cada provincia; lo cual fortalece el trabajo en esta compleja tarea como parte de un sistema nacional.  </p>
      <p>Cobra un valor agregado incluir en el libro un glosario jurídico - penitenciario, que es de hecho muy útil para cualquier lector, pero con mucha relevancia para los estudiantes de la carrera de Licenciatura en Derecho que tendrán en sus manos una importante bibliografía completaría, para profundizar en el estudio de los temas de la asignatura de Criminología donde se abordan aspectos relacionados con el sistema penitenciario y la prevención del delito. </p>
      <p> Aunque el libro “Política Penal y penitenciaria. El reglamento del sistema penitenciario en el contexto actual de desarrollo de la sociedad cubana. (Glosario jurídico - penitenciario)”, es predominantemente una literatura técnica de la ciencia del Derecho y la Criminología, nunca pierde la sencillez de su narrativa que posibilita la compresión de la esencia de la política penitenciaria en Cuba.</p>

         <p>In the coherent confrontation of criminal activity, the existence of a solid criminal policy is vital to channel the path to follow in order to counteract with certain effectiveness the complex and dynamic world of crime; from the simplest transgressions of the legal system to the consummation of the most serious crimes, as well as the care of those punished in penitentiary establishments. </p>
         <p>Although from the general theory of criminological science the term criminal policy is used to define the set of measures to confront criminal activity, in Cuba it is called penal and penitentiary policy. The book "Criminal and Penitentiary Policy. The regulation of the penitentiary system in the current context of development of the Cuban society (Legal - penitentiary glossary)" has the merit of deepening in one of the no less complex edges of the confrontation to the criminal activity, the treatment to those punished in the penitentiary system.</p>
         <p>The author goes from general considerations on criminal policy, to go deeper and deeper, with scientific and legal arguments, into the criminal policy in Cuba, with a marked emphasis on the dimension that this general policy reaches in the penitentiary system, which in short is the central objective that is pursued and achieved with the edition of the book.</p>
         <p>From chapter V "Penitentiary policy and its antecedents", the author with some brief ideas on Marti's thought about prisons, divides his analysis, as it almost always happens in this type of valuations, in two great periods, before the triumph of the Cuban revolution on January 1, 1959 and from this historical fact that changed the destinies of the Cuban people towards a more promising future (<xref ref-type="bibr" rid="B1">Zequeira, 2020</xref>).</p>
         <p>The book only makes brief sketches about the penitentiary regime in Cuba before 1959, to dedicate space and time to analyze the most fruitful period of the deployment of the penitentiary policy in Cuba, which began on January 1, 1959 and extends to the present day, although for logical reasons the book does not address the most recent achievement of this policy as the approval of Law number 152 of 2022 "Law of Penal Execution", and the rescue of Fidel's thought about the integral attention of the penitentiary system, which includes the extension of university education to it.</p>
         <p>The law professional, the student or any person that for diverse reasons enters in the study of this interesting book, will find in the didactic order, that chapter VI is divided in five brief moments the main milestones that has had the treatment of the penitentiary policy in the revolutionary Cuba, although in our opinion it is important to consider, in the "Second Moment", the contributions of the thought of the Commander in Chief Fidel Castro Ruz to the development of the penitentiary system, for which it would be useful to approach the speech pronounced by Fidel, on June 6, 1971, in the act for the tenth anniversary of the constitution of the Ministry of the Interior.</p>
         <p>With the recognition of the penitentiary policy as part of the State's criminal policy, Chapter VII briefly outlines the three approaches that the author defines as the bases of the management of a prison; to give way in the following chapter to a brief analysis of the relationship between the policy and the Penitentiary Law, asserting that the penitentiary policy reaches constitutional rank for the first time with the approval of the Constitution of 2019, considering what is explicitly established in Article 60 of the Cuban Magna Carta.</p>
         <p>The reader should evaluate that according to what is established in Article 60 of the Constitution of the Republic of Cuba, the penitentiary policy goes beyond the framework of penitentiary establishments, by including within it the social reintegration of persons deprived of liberty, therefore, several ministries and political, social and mass organizations participate in its implementation.</p>
         <p>The reader will find interesting the "Points of view on a prison", which are presented in chapter IX of the text. Concepts such as "Minimum and Complete City", "Hospital Prison", "Clock Prison", "Laboratory Prison" and "Meteorological Institute Prison" will captivate the motivation of those who approach the reading of the book; with which from a critical point of view one may or may not agree, but it is undoubtedly a contribution of the author to the debate on the complexities of the penitentiary system.</p>
         <p>For those interested in penitentiary policy, it will be valuable to know the definition of penitentiary treatment, which is why it is useful that in Chapter X the author provides readers with some of the concepts that have been debated in science and the definitions established by law. </p>
         <p>When analyzing penal and penitentiary policy, the evaluation of the principles that sustain the Cuban penitentiary system cannot be absent, an aspect that is rightly addressed in chapter XI of this interesting book. From "Humanism" to the "Individual, differentiated and systemic approach to the educational process", the main principles that sustain the Cuban penitentiary system are explained. In the study of these principles, it is appropriate to review the annex of the Penal Execution Law, which establishes concepts and definitions applicable to this legal body, and defines terms such as humanism, legality, right to defense, among others.</p>
         <p>Chapters XII and XIII deal with the main aspects of the organization and operation of penitentiary establishments. Although the objective of these chapters is to go directly to the internal functioning of the penitentiary establishments, the existence of a Head of the Penitentiary System at the level of the Head of the Ministry of the Interior in each province, who directs the integral functioning of each penitentiary establishment, given the existence of more than one in each province, cannot be overlooked, which strengthens the work in this complex task as part of a national system.  </p>
         <p>The inclusion in the book of a legal - penitentiary glossary has an added value, which is indeed very useful for any reader, but with much relevance for the students of the Bachelor's Degree in Law who will have in their hands an important bibliography to deepen in the study of the topics of the subject of Criminology where aspects related to the penitentiary system and crime prevention are dealt with.</p>
         <p> Although the book "Penal and Penitentiary Policy. The regulation of the penitentiary system in the current context of development of Cuban society (Legal - penitentiary glossary)", is predominantly a technical literature of the science of Law and Criminology, it never loses the simplicity of its narrative that makes possible the understanding of the essence of the penitentiary policy in Cuba.</p>
